Michelle Edmark, Warden, New Hampshire State Prison, Respondent O R D E R On January 28, 2004, Dickens Etienne shot an acquaintance, Larry Lemieux, in the back of the head. Lemieux died instantly. Etienne was tried and convicted of first-degree murder and his conviction was affirmed on appeal to the New Hampshire Supreme Court.
