MEMORANDUM OPINION

I. INTRODUCTION

This cause is before the court on a Motion to Dismiss (doc. # 5) for want of jurisdiction and for failure to state a claim upon which relief can be granted filed by Donald E. Williamson (“Williamson”) and the State of Alabama Department of Public Health (“ADPH”) (collectively “Defendants”) on January 18, 2001, as well as on a conditional Motion to Amend Complaint to Add Parties (doc. # 8) filed by Madie E.
