MEMORANDUM OPINION AND ORDER

This cause was brought on for hearing before this Court on a Complaint by Swiss Air Transport Company, Ltd. seeking a declaratory judgment that its rights in five DC-9-32 aircraft owned by TXIA Holdings Corporation, a debtor in possession in the consolidated Continental filings, are subject to the provisions of section 1110 of the Bankruptcy Code, and on a subsequently filed motion for relief from the automatic stay pursuant to Section 362 of the Bankruptcy Code.
