Defendant appeals from the judgment of the lower court condemning him to pay a license tax of five dollars, for the year 1877, on his business as a peddler of ice-cream on the streets of the city.

*1076Defendant resists the payment of the license on the ground that the sale of articles of one’s own manufacture does not subject the seller to the payment of a license-tax to the city, and that the ordinance is illegal in that respect.
