OPINION

GWIN, District Judge.

This case returns to us for a third time. Most recently, we affirmed the judgment of the district court. French v. Jones, 282 F.3d 893 (6th Cir.2002). Thereafter, the United States Supreme Court granted respondent’s petition for writ of certiorari, vacated our prior judgment, and remanded the case to our Court for further consideration in light of its decision in Bell v. Cone, 535 U.S. 685, 122 S.Ct. 1843, 152 L.Ed.2d 914 (2002). Jones v. French, 535 U.S. 1109, 122 S.Ct. 2324, 153 L.Ed.2d 153 (2002). Pursuant to the Supreme Court’s order, the case is again before…
