On rule to show cause. Eugene T. Henry, the defendant, was the owner of a tract of land in the State'of Pennsylvania, containing about thirteen hundred acres. Upon the facts set out in the foregoing statement of the case, the plaintiff brought his action against the defendant to recover compensation for his services in negotiating the sale. At the circuit, the cause was tried by the court — a jury being waived — and the finding of the court was in favor of the defendant.
