OWENS, District Judge.
Before the court is defendant’s second summary judgment motion, filed in the wake of this case’s remand from the Eleventh Circuit. This court granted defendant’s first summary judgment motion. As a matter of law, the court held that defendant had canceled the property insurance policy at issue prior to the fire that damaged the building that had at one time contained plaintiffs then-defunct business.
