MEMORANDUM OPINION
MORRIS SHEPPARD ARNOLD, District Judge.
This is a declaratory judgment action brought by an insurer to determine which of two insurers must cover the insured’s potential liability in a state court tort suit. The case has expanded to include counterclaims by the insured and the tort victims against the insurer-plaintiff, and cross-claims by the insured against the insurer-defendant and by the tort victims against the insured.
