In an action to recover damages for personal injuries, etc., the plaintiffs appeal from so much of an order and judgment *459(one paper) of the Supreme Court, Suffolk County (Underwood, J.), entered November 22, 1996, as, upon a jury verdict finding the defendant Paul A. Strohrmann 100% at fault for the happening of the accident, dismissed the complaint insofar as asserted against the defendant Paul Oliva.
Ordered that the order and judgment is affirmed insofar as appealed from, with costs.
