OPINION ON SECOND MOTION FOR REHEARING
HUTSON-DUNN, Justice.
The State has filed a second motion for rehearing. We overrule this motion. However, the opinion issued by this Court on November 18, 1993, is withdrawn, and the following opinion is filed in lieu thereof.
Initially, the appellant was convicted of murder and given life imprisonment. On November 30, 1989, this Court reversed that conviction and remanded for a new trial. Doherty v.
