Poffenbarger, Judge:

By a judgment of the circuit court of McDowell county, rendered on the 6th day of June, 1904, in an action of ejectment, H. Randall Webb and others, claiming 1,000 acres of land under a patent, issued by the Commonwealth of Virginia to John F. Webb and Edwin L. Parker, dated July 3, 1860, recovered the same from W. M. Ritter, who claimed it, mediately, as part of a grant, of 320,000 acres, made by the Commonwealth of Virginia to Robert Morris, on the 4th day of March, 1195, together with $9,966.66, as compensation for damages done to it by the cutting and removal of timber…
