I. BACKGROUND/SIXTH CIRCUIT OPINION SUMMARY
On May 15, 1995, the Debtor, Dow Corning Corporation (“Dow Corning” or “the Debtor”) filed a voluntary petition for relief under chapter 11 of the Bankruptcy Code. On November 8, 1998, the Debtor and the Official Committee of Tort Claimants (“Tort Claimants’ Committee”) submitted a Joint Plan of Reorganization, amended on February 4, 1999.
