This is an action of contract to recover $259.17, with interest from August 20, 1917, and is before this court on an appeal from the Appellate Division of the Municipal Court of the City of Boston.

A concise statement qf the facts, as shown by the reported testimony and agreed facts, is as follows: On August 20, 1917, the plaintiff made a signed written application to the defendant for a foreign cable transfer of money to his sister at Erivan, Russia.
