Appeal from special term, Monroe county. Action by Charles Brigham, as executor of the will of Harriet T. Sedgwick, deceased, against Delia A. Gott, to set aside a transfer of shares of stock made to defendant by the deceased, and for other relief. Judgment for plaintiff, and defendant appeals.

Harriet T. Sedgwick died in Monroe county on the 26th day of May, 1887, leaving a last will and testament, in which she appointed the plaintiff sole executor. The will has been duly admitted to probate. For some years prior to her death she was the owner of certain shares of stock of the Delaware & Hudson Canal Company, of the par value of $1,500. For about two years prior to her death she resided with the defendant, Delia J. Gott. She was of the age of 87 years at the time of her death, and had been sick and infirm for some time prior thereto. A short time prior to her death she transferred…
