I. INTRODUCTION
This matter returns to the court on remand from the United States Court of Appeals for the Ninth Circuit following its decision in Lahoti v. VeriCheck, Inc., 586 F.3d 1190 (9th Cir.2009). Prior to the appeal, the court conducted a bench trial in this matter that began on November 6, 2007.
