Tbis action was brought against tbe S. and W. Bailroad Company and its successor, tbe C. O. and 0. Railroad Company, and tbe Meadows Company, wbicb was tbe original contractor for the whole work, and the appellant MacArthur Company, to whom the contract was sublet, they in turn subletting 18 miles of the work to the plaintiff. At the trial a non-suit was taken as to the Meadows Company, except to the extent that the debt due by it to the MacArthur Company had been attached by the plaintiff to satisfy any judgment he might obtain against the MacArthur Company.
