OPINION OF THE COURT

This is a proceeding to vacate or reduce a special assessment levied against the property of the petitioner for the cost of demolition of petitioner’s building by the respondent.

The assessment in this case is the aftermath of a series of *597events precipitated by the collapse of two four-story buildings in the downtown central business district of the City of Gloversville.
