ORDER ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

HEMPHILL, District Judge.

On September 12, 1977, defendant moved for summary judgment on the ground that plaintiff is not entitled to any relief for damages because the defendant does not afford automobile liability coverage to plaintiff while operating a nonowned motorcycle, since such vehicle is not within the coverage of the policy. This brings the critical issue of this lawsuit, originally filed in the Court of Common Pleas for Richland County, South Carolina, and duly removed to this court on June 30, 1977.
