This is a proceeding brought by citizens and taxpayers for a peremptory order of mandamus to compel the respondents to conduct the election for councilmen in each of the boroughs of the city of New York at the general election in 1937 pursuant to the provisions of subdivision b of section 22 of the New Charter of the City of New York (New York City Charter, adopted Nov. 3, 1936, in effect Jan. 1, 1938) and not pursuant to chapter 43 of the New Charter, on the ground that chapter 43, which provides for the election of councilmen by a system of proportional representation, is unconstitutional.…
