Error to Oakland; Smith, J. Carroll Beardsley was convicted of manslaughter, and sentenced to imprisonment for not less than one nor more than fiveyears in the State prison at Jackson.

Respondent was convicted of manslaughter before the circuit court for Oakland county, and *207was sentenced to the State prison at Jackson for a minimum term of one year and a maximum term not to exceed five years. He was a married man living at Pontiac, and at the time the facts herein narrated occurred, he was working as a bartender and clerk at the Columbia Hotel. He lived with his wife in Pontiac, occupying two rooms on the ground floor of a house. Other rooms were rented to tenants, as was also one living room in the base-, ment.
