This is a non-dischargeability proceeding under 11 U.S.C. §§ 523(a)(2) and 523(a)(4) brought against William Ernst (the “debt- or”) based on the conduct of his non-filing spouse, Lisa Ernst. The present matter before the court is a motion to dismiss under Rule 12(b)(6) of the Federal Rules of Civil Procedure seeking dismissal of the dischargeability complaint filed by Ameri-safe, Inc., American Interstate Insurance Company, and Hanover Insurance Company (collectively, “Amerisafe” or “plaintiffs”).
