Plaintiff, Donna Combs, as personal representative of the estate of Glen Dale Combs, deceased, filed a petition in the Circuit Court of Texas County, Missouri to recover the benefits of a life insurance policy on the life of Glen Dale Combs. The defendants are Koch Industries, Inc. (“Koch”) and the Metropolitan Life Insurance Company (“Met”). The case was removed to this Court on the basis that the suit claimed benefits under Koch’s Employee Welfare Benefit Plan and which is governed by the laws of the United States under the Employee Retirement…
