Memorandum: Defendant appeals from a judgment convicting him upon a jury verdict of two counts of murder in the second degree (Penal Law § 125.25 [1]) for beating his parents to death with a hammer. In convicting defendant, the jury rejected his affirmative defense that he lacked criminal responsibility by reason of mental disease or defect (see, Penal Law § 40.15).
