*1297Appeal from a judgment of the Erie County Court (Shirley Troutman, J.), rendered January 18, 2006. The judgment convicted defendant, upon a jury verdict, of murder in the second degree, attempted murder in the second degree, assault in the first degree and criminal possession of a weapon in the second degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
