Pope, Judge.

Kuhlke Construction Company contracted with Mobley, Inc. to expand Mobley’s restaurant building in Waynesboro, Georgia. Following completion of the expansion project, several problems arose relating to the quality of the workmanship. The contract price was $42,328.00 of which Mobley had paid $13,117.00. After several months of unsuccessful negotiations, Kuhlke instituted this action for the balancé due and payable under the terms of the contract, $29,211.00, plus attorney fees as provided by the contract. Mobley counterclaimed for damages in the amount of $40,000.00.
