The undisputed facts are as fdlows:

Plaintiff in error was indorser on a note for G. N. and Martha E. Kneeland, said note bearing date of October 23, 1931, for the principal sum of $1,760, together with interest at tbe rate of 8 per cent, per an-num until maturity and 10 per cent, after maturity until paid, and for $176 attorney’s fees. On July 5, 1933, said bank filed suit on said note and duly issued summons to the defendants therein named.
