This is an action for maintenance and cure brought by libellant (Stone) against the respondent, libellant’s employer, for the consequences of an alleged assault by a fellow seaman (Plyler) upon libel-lant Stone, an able-bodied seaman, on January 20, 1956, while in the service of a ship operated by respondent. Later Stone brought an action against his employer, for the same incident, under the Jones Act (46 U.S.C.A. § 688). The cases were heard together on December 1, 2, 3, 7, 8 and 9, 1959.
