STATEMENT OF THE CASE

Nora May McCormick, Personal Representative of the Estate of Paul McCormick, deceased (“McCormick”), appeals from the trial court’s grant of summary judgment in favor of the State of Indiana, its Department of Natural Resources (“the State”) and the Indianapolis Water Company (‘Water Company”). The decedent died in a boating incident at Morse Reservoir when he and his boat went over a spillway near the dam.
