This was an action by Arbuckle Brothers, plaintiffs, against tbe defendant to recover tbe purchase price of 110 bags of sugar sold to tbe defendant, for which it refused to pay.

*96In the summer of 1920, sugar was scarce and high, and the difficulty in getting transportation was great. So great was this difficulty that the plaintiff would not ship in less than carloads, with a minimum of 60,000 pounds, and “all of these parties were aware of the practice of shipping sugar to Richmond in car lots.’.’ Such were the conditions when the contract in suit…
