On November 15, 1893, the appellant filed in the United States Court for the Northern District of the Indian Territory the following complaint:
“Plaintiff complains:
“ (1) That on March 26, 1889, Thomas B. Needles was appointed marshal of the Indian Territory for a term of four years.
“(2) That on March 29, 1889, for the faithful performance of his duties as such marshal by himself and by his deputies, the said Thomas B. Needles, together with the defendants Charles B. Farwell and Daniel Shepard, executed to the United States of America their bond in the sum of twenty thousand dollars, which…
