The parties will be referred to as they appeared in the lower court, defendant in error being plaintiff and the plaintiffs in error defendants.

The plaintiff instituted this action to recover from defendant H. R. Leland $4,628.-83, the balance it claimed due for the construction of a building for said defendant, and for foreclosure of contractor’s lien on certain real estate and improvements owned by said defendant.
