Appellee Margarito Rodriguez filed suit against appellant Harlandale Independent School District (HISD), asserting various causes of action based on age and gender discrimination and breach of contract. HISD filed a plea to the jurisdiction seeking dismissal of Rodriguez’s claims for breach of contract and breach of the duty of good faith and fair dealing because Rodriguez failed to pursue a grievance through the administrative process prior to filing suit in district court.
