MEMORANDUM OPINION
(July 14, 2010)
Defendant moves1 to dismiss Count Eight of the Information, asserting that 14 V.I.C. § 2253(b)2 is unconstitutional based on District of Columbia v. Heller, 554 U.S. 570, 128 S. Ct. 2783, 171 L. Ed. 2d 637 (2008).3 Defendant also asserts the statute violates “the Fourteenth Amendment, the equal protection clause, the due process clause, and the Revised Organic Act.”
