OPINION

J. HARVEY HUDSON, Justice.

Appellant, Ricky L. Gandy, was charged by indictment with illegal dumping. 1 The indictment also contained an enhancement paragraph alleging a previous conviction for illegal dumping. The cause proceeded to trial before a jury. After considering the evidence presented, the jury found the appellant guilty of the offense charged. Thereafter, appellant entered a plea of “true” to the enhancement allegations, and the jury subsequently assessed appellant’s punishment at a probated sentence of five years and a fine of $10,000.
