Before me is the defendants’ motion, Filing No. 32, to dismiss the plaintiffs amended complaint, Filing No. 30. The parties have submitted briefs in support of their positions.

Alliance, Nebraska police officers 1 arrested and detained the plaintiff in July 2000 on an outstanding warrant from Scotts Bluff County, Nebraska, after they stopped the plaintiff for speeding.
