We granted certiorari in Eagle Peak Farms, Ltd. v. Colorado Ground Water Commission, 870 P.2d 589 (Colo.App.1993), 1 to determine whether the court of appeals erred in holding that de novo review of a rule promulgated by petitioner, the Ground Water Commission (Commission), is to occur before a ground water judge and, if so, whether such review violates the separation of powers doctrine.
