The defendant, Roy, was convicted by a jury and sentenced to 90 days in jail on a warrant charging him with promoting and being concerned “in managing a lottery, to-wit, a numbers game,” and having in his possession for the purpose of sale “a chance or ticket in or share of a ticket in said lottery.” His trial in the circuit court was on appeal from a conviction by the county court.
The evidence is not before us, but it is certified by the trial judge that the defendant concedes that the evidence introduced was sufficient to support the verdict of the jury. The errors assigned relate solely to…
