This is an appeal of a denial of a delayed firefighter cancer claim brought under Section 108(r) of the Workers' Compensation Act (Act), 1 one of the provisions of the 2011 amendments to the Act known as Act 46, 2 which, among other things, added cancer to the list of occupational diseases for individuals employed as firefighters. The main question is whether the claimant's right to pursue a medical-only claim was extinguished prior to the 2011 effective date of Act 46, which generally broadened compensability for cancer caused to firefighters.
