Defendant in error was employed by the plaintiff in error as special agent to interview the policy holders of said company with the view of getting additional insurance from them, in which event the parties were to execute premium notes and deposit their old policies with the company as collateral security. Defendant in error set out the various policies which he claims to have sold under this contract, and by virtue of which he was to have received specified commissions and an additional 5 per cent, on renewals, and alleged that the same had never been paid.
