*942Initially, the Supreme Court properly considered the merits of the plaintiffs motion and the defendant Eduardo M. Cornejo’s cross motion pursuant to CPLR 4404 (a) to set aside a jury verdict in favor of the defendants Rajiv R. Mody and Rufino Rodriguez on the issue of liability and for a new trial. The parties’ so-called “high-low” agreement did not expressly prohibit the making of the subject postverdict motion and cross motion (see Doubrovinskaya v Dembitzer, 77 AD3d 609, 610 [2010]; Grochowski v Fudella, 70 AD3d 1407, 1408 [2010]; Cunha v Shapiro, 42 AD3d 95, 100 [2007]).
