Appeal from an order of the Supreme Court, Erie County *1355(Henry J. Nowak, Jr., J.), entered January 9, 2014. The order granted plaintiff’s motion to set aside the jury verdict and ordered a new trial.

It is hereby ordered that the order so appealed from is unanimously reversed on the law without costs, the motion is denied and the verdict is reinstated.
