MORRISON, Presiding Judge.

The offense is murder; the punishment, 5 years.

The appellant was the proprietor of a beer establishment on the night charged in the indictment and, as such, had separated the deceased and another of his patrons who got into an argument over a woman. The deceased resented the appellant’s intervention and addressed some opprobrious epithets toward the appellant, who countered by commanding the deceased to go home.
