KRUEGER, Judge.

The appellant was tried and convicted of the offense of robbery by assault and his punishment was assessed at confinement in the penitentiary for a term of ten years.

The testimony adduced by the State shows that on the morning of April 27th, A. D. 1934, Mrs. Edwina Berg went from Longview, Texas, to Shreveport, La., where she purchased a quantity of whisky for the purpose of transporting it to Longview and selling it.
