On the first appeal of this case, the circuit court had sustained a demurrer to the plaintiff’s petition. This court field tfie petition good, and remanded tfie case for furtfier proceedings. See Commonwealth v. Ginn & Company, 111 Ky. 110, 23 Ky. L. R. 521; 63 S. W. 467. On tfie second appeal tfie circuit court fiad overruled tfie plaintiff’s demurrer to tfie amended answer, and, plaintiff declining to plead furtfier, it again dismissed tfie petition.
