MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
Anthony and Marie Bieganek sue for damages allegedly suffered because of commodities fraud by the defendants. Their ten-count amended complaint includes claims under the Commodities Exchange Act (“CEA”), 7 U.S.C. § 1 ei seq., the Racketeer Influenced and Corrput Organizations Act (“RICO”), 18 U.S.C. § 1961 et seq., as well as pendent common law claims for fraud and conversion. Defendants Gary Wilson (“Wilson”), Oppenheimer & Co. (“Oppenheimer”) and Rouse-Woodstock, Inc. (“Rouse”) have moved to dismiss the complaint, and Oppenheimer has since…
