WILLIAMS, Justice.
This is an appeal from a judgment of the District Court of Collin County, Texas admitting to probate the last will and testament of Capitola Barnett, deceased. On June 18, 1963 B. B. Carpenter, Jr. filed application in the County Court of Collin County, Texas to probate the last will and testament of Capitola Barnett, deceased, said will being dated May 27, 1955 and the codicil thereto being dated March 3, 1956.
