Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered July 2, 2013, convicting defendant upon his plea of guilty of the crime of falsifying business records in the first degree.

Defendant pleaded guilty to one count of falsifying business records in the first degree in satisfaction of a two-count indictment and other pending and potential charges. When the plea was entered, County Court agreed to impose a prison sentence of IV2 to 3 years and made further assurances that it would order defendant into a shock incarceration program (see Correction Law § 865 [2]).…
