Action by George B. Estelle against Mary Dinsbeer. There was a judgment in favor of plaintiff, and defendant appeals. Reversed.

This action was brought to recover $109 claimed to be due on the 15th February, 1894, as an installment under a chattel mortgage which was given by the defendant to the plaintiff upon the purchase of the furniture in the house 244 West Thirty-Mnth street. The answer was a general denial, payment, and fraud; the fraud, as claimed by the defendant, consisting in the representations that the furniture sold was free and clear; that the house brought in an income of $400 per month; and that the neighborhood was good,—all of which defendant claimed were false, inasmuch as the furniture was at the…
