POPE, Justice.

Plaintiffs, Erich Poehnert and wife, sued Bert Coryell, his wife, Isabel Coryell, and the Estate of Allen Wilson, upon a promissory note for $2,000. The case was tried without a jury, -and after hearing the evidence, the court granted judgment for plaintiffs against Bert Coryell and wife, but denied recovery against the Estate of Allen Wilson. Plaintiffs appealed from that part of the judgment which denied recovery against the Wilson Estate.
