MEMORANDUM OPINION

CHURCHILL, Chief Judge.

This case presents an interesting question of first impression concerning the re fined policy manual leg of the Michigan Toussaint doctrine. Because the Court finds that employees who are covered by collective bargaining agreements cannot establish the fairness consideration necessary to support a cognizable Toussaint policy manual claim under Michigan law, the Court shall dismiss Count I of Plaintiff Danny Shivers’ complaint.
